Terms of Use

These Terms of Use (the “Agreement”) outline the rules and guidelines for using www.sofialabs.com and its associated websites, including sofialabs.creativesquadz.com (collectively referred to as the “Website”).

Terms and Conditions of Service

  • “Conditions” refers to these terms and conditions.
  • “Company” refers to sofialabs Pvt. Ltd.
  • “Customer” refers to you, the user.

1. General Terms

The services offered are as described in the services list. By placing an order, the Customer agrees to these terms and conditions. These terms may be updated at any time, and it is the Customer’s responsibility to review them before placing an order. All orders are subject to the Company’s acceptance and service availability.

To complete an order, the Customer must provide their full name, address, and contact details. Please refer to the Company’s Privacy Policy for more information about data collection and usage practices. Upon receiving the order, the Company will confirm the order in writing (via email, SMS, WhatsApp, or other communication methods).

The Company will make reasonable efforts to provide the services promptly, typically within 7 days of payment, though no guarantee of delivery within that timeframe is implied. These terms will apply to all contracts for the sale of services, overriding any conditions stated by the Customer in their order or negotiations.

2. Pricing

The service prices (the “Price”) are listed on the Price List and are accurate at the time of publication. However, the Company reserves the right to change the prices without prior notice. All prices are quoted in Indian Rupees (INR) and include all applicable taxes or charges to be paid by the Customer.

3. Payment and Delivery

Unless otherwise agreed upon in writing, the full payment (including taxes and additional costs like postage/packaging) must be made by the Customer before the services are delivered. The Company will provide payment options such as credit/debit cards, net banking, UPI, and payment wallets (for Indian customers).

In the case of home visits or deliveries, convenience charges will apply. The Company is not responsible for any issues related to payment procedures. Payment responsibility lies solely with the Customer.

The Company reserves the right to charge listing fees or transaction fees for certain services offered through the Website. The Company also reserves the right to modify these fees at any time without notice.

Test reports, if applicable, will be delivered within 7 working days, unless otherwise stated. The Company will make every effort to deliver on the preferred date but is not liable for delays. If a partial payment is made, the test reports may not be issued due to administrative or technical reasons.

4. Refunds and Cancellations

While the Company will strive to meet the Customer’s needs, it is not obligated to accept order cancellations or amendments. If the Company agrees to cancel an order, the Customer will be responsible for any costs incurred up until the cancellation date.

The Company may cancel any contract at its discretion and will refund any amounts paid by the Customer. Cancellations and refunds can be requested via email at care@sofialabs.com. Refunds will be issued to the same payment method used for the original transaction.

5. Use of Service

The Service Information Sheet, which accompanies the Services, provides guidelines for use and storage. However, the Company does not take responsibility for any loss or damage resulting from reliance on this information.

The Customer must notify the Company in writing of any service issues or non-performance within 10 days of service delivery. Failure to do so will result in the Company not being liable for any issues.

6. Liability

Except for liability arising from death or personal injury caused by the Company’s negligence, the Company’s liability under these terms is limited to the price paid by the Customer for the relevant services. The Company will not be liable for indirect or consequential damages such as loss of business, revenue, or goodwill, even if the possibility of such damages was known.

7. Quality Control

The Company will make efforts to comply with relevant regulations and legal requirements.

8. Termination

The Company may suspend or terminate services if the Customer breaches these terms or enters insolvency proceedings. Termination will not affect the rights accrued up to that point.

9. Miscellaneous

If the Company is unable to deliver services due to circumstances beyond its control, it may cancel or delay the contract without liability, though a refund will be provided if the delay is not due to the Customer’s actions.

These terms will be governed by Indian law, and the Customer consents to the non-exclusive jurisdiction of Indian courts. If any provision is found invalid or unenforceable, the remaining provisions will still apply.

The headings in these terms are for convenience and do not affect their interpretation. If the Company does not strictly enforce these terms, it does not waive any rights. All notices must be sent in writing to the Company’s or Customer’s address and will be deemed delivered upon the first working day after being sent via hand delivery, telex, or facsimile, or on the third working day after being mailed by first-class post.
